Design Submission & Intellectual Property Guidelines

 

OneOfAKindCloth.com is a platform for original creators and we act only as a manufacturing service. To ensure compliance with copyright, trademark, and right of publicity laws, all users must adhere to the following strict rules when uploading or designing products.

Failure to comply may result in the immediate removal of content and account termination under our Repeat Infringer Policy.

 

Do Not Upload Prohibited Content

 

The following types of content are strictly prohibited and will result in the immediate cancellation of your order and potential account termination:

  • Brand Logos & Trademarks: No use of registered brand names, corporate logos, slogans, or identifiable product packaging (e.g., the Nike Swoosh, Disney characters, the Apple logo).

  • Celebrity Likeness (Right of Publicity): No photos, illustrations, names, or quotes of famous people, athletes, actors, politicians, or other public figures without explicit, written permission from the individual or their estate.

  • Copyrighted Characters: No characters, images, or scenes from movies, TV shows, video games, comic books, or books (e.g., Mickey Mouse, Marvel/DC heroes, Harry Potter).

  • Unauthorized Artwork: No photographs, stock images, or third-party artwork found on the internet unless you personally own the copyright or possess a commercial license that specifically permits print-on-demand sales.

  • Hate Speech/Illegal Content: No content that promotes illegal activity, hate speech, harassment, violence, or obscenity (as defined under law).

 

Allowed Content

 

You CAN create designs using content that falls into the following categories. Note: Users bear the full legal responsibility for any claim of infringement, even if they believe their content falls under Fair Use or Parody.

Category Description Risk & User Responsibility
1. Your Own Original Work Any artwork, photos, or text created entirely by you and not substantially derived from a protected work. LOW RISK. You own the rights to this content.
2. Public Domain Content Art or text whose copyright has verifiably expired (generally very old works). LOW RISK, but user must verify public domain status.
3. Licensed Content Art, fonts, or stock imagery for which you hold a valid commercial license with explicit rights to use in print-on-demand manufacturing. LOW RISK, provided the user strictly adheres to the license terms.
4. Fair Use & Transformative Works Content that is significantly transformedfrom the original and used for purposes of criticism, commentary, news reporting, or education. HIGH RISK. Fair Use is a complex legal defense and rarely applies to commercial merchandise. The user must ensure the design adds new meaning or expression.
5. Parody, Satire, & Expressive Speech Designs that use a protected work to mock or comment on that specific original work (Parody) or to comment on society/politics using copyrighted material (Satire/Political Speech). VERY HIGH RISK. These are legal defenses, not rights. If the design could be mistaken for official merchandise or harms the market value of the original, it is likely infringement. The user assumes all legal liability.

Fair Use is a Legal Defense, Not a Guarantee. A court, not OneOfAKindCloth.com, makes the final determination of whether a design is protected by Fair Use or is infringing. By uploading content that relies on these defenses, you acknowledge and accept that you are assuming all legal and financial risks associated with any claim brought by the original intellectual property owner.
